   Jeśli rzeczywiście doszło do skutecznej modyfikacji zapisów umowy, a nie dotrzymano terminu załadunku i rozładunku, istnieją podstawy do obciążenia drugiej strony kosztami, które z tego wynikły. Trzeba tylko udowodnić związek przyczynowy i wysokość szkody.
