Z reguły gdy towar przekazany przewoźnikowi w należytym stanie dociera do miejsca przeznaczenia uszkodzony, przewoźnik ponosi odpowiedzialność za szkody powstałe w przesyłce niezależnie od tego, czy można mu zarzucić nienależytą staranność czy też wszystkie swoje obowiązku wykonał prawidłowo.
