Database of international law concerning the CMR Convention

CMR Convention in force in several countries, what causes, given that each year there are thousands of decisions based on its provisions. Unfortunately, as a rule, the decision shall be published (if at all) only in the country and with few exceptions (in particular any judgments brought to the magazine European Transport Law) are not available to most practitioners. However, in many cases such decisions could be useful in cases conducted m.in. Polish courts, especially as the Polish judicature in terms of the CMR Convention is not too extensive. For these reasons, I believe to be extremely valuable in person implemented into an international initiative to create a base case, based on the CMR Convention.

The database began to be formed several months ago by UNIDROIT International Institute for the Unification of Private Law (International Institute for the Unification of Private Law). Recently, the project was taken over by the French IDIT Law Institute International Transport and Logistics Rouen w (Institute for International Law of Transport and Logistics), which intends to standardize entries on individual decisions (so far all entries of different authors have different structure, making it difficult to browse the database).

The new database available on the Institute website has a friendly interfacemożliwiający search decisions by subjects, that, Articles, keywords and phrases, countries, in which the decision was made, and even cities. Each entry contains information on the decision, list of topics, concerned, and its executive summary and the thesis, if it was formulated. In some entries, you can come across as well as his own observations of the person making an entry about the issues raised in the judgment. The entries are in English and French, although in the case of judgments is still only one language version.

In addition to the judgments in the database is also bibliography involving hundreds of scholarly articles devoted to the CMR Convention published in magazines in different countries.

The database of decisions There are currently more than 2.500 entries 11 countries, which however does not translate to the same number of judgments, because the entries in English and French are counted separately. Estimates so you can take, that the number of decisions is about. 1500. Unfortunately, among them the lack of any judgment of the Polish. So far, the only Polish accent is declared as a bibliography article A. Blacha: Contract of carriage of goods by car ACCORDING new transport law and CMR.

I hope, however,, that this situation will soon change. I am pleased to inform you because, that I was entrusted with the function of the correspondent Idit the Polish case is based on the CMR Convention. With the MEC. François Wojcikiewicz French lawyer specializing in transportation law to prepare the development of the available decisions issued by the Polish courts in English and French, so they should be included in the database.

Therefore, I have an appeal to the readers to send in interesting decisions in the CMR Convention issued by the Polish courts, especially the higher authorities. Only a small part of these decisions are published, and through publication in the base case is a chance to become acquainted with them by a larger number of people. Thank you in advance 🙂
