The first entry on the blog Fri. “Doubtful changes in CMR” as a statement of objections relating to the validity of the new regulation pointed out non-publication Polish version of the Protocol to the CMR Convention in the Official Gazette. So I hasten to report, that this allegation is obsolete.
On 05.04.2011 r. in the Official Gazette No. 72 appeared for two positions on these provisions,:
Item. 392 – Polish text of the Protocol to the CMR Convention
Item. 393 – government statement on the binding force of the Protocol to the CMR Convention
Now remains the question of new rules only with reference to unconstitutional mode of ratification of the Protocol.
Unfortunately, this proved to be the concerns about the quality of the translation Text of the Protocol into Polish. The Polish text “date or jugdement” used in art. 23 paragraph. 7 CMR translated into “evaluation date” instead of “days of the judgment”. However, I hope, that the Polish courts in the interpretation of the Protocol will be referred to the original text English or French and do not have a problem with setting, that day is “date of assessment”.
It is found on the occasion of the first things – can be really interesting.
