Niemiecka ustawa o płacy minimalnej z dnia 11 August 2014 r. (Mindestlohngesetz – MiLoG) ze zrozumiałym względów od początku tego roku zaprząta głowę zdecydowanej większości polskich firm transportowych. Brak jasności nowej regulacji i niewiadomy zakres jej zastosowania sprawiają, że polscy przewoźnicy nie mają pewności, w jaki sposób poruszać się w nowej rzeczywistości i jakie konsekwencje mogą ponieść w przypadku popełnienia błędu. Publikacje w prasie branżowej i wypowiedzi przedstawicieli organizacji transportowych koncentrują się przede wszystkim na potencjalnych karach nakładanych przez niemieckie organy celne, które mogą sięgnąć nawet 500.000 Euro. Dużo bardziej prawdopodobne zagrożenie nadejdzie jednak raczej z zupełnie innego kierunku – z roszczeniami zaczną występować polscy kierowcy. Continue reading →

Is diet and a lump sum per night can be assigned to the German minimum wage?

Euro currencySince the beginning of the Polish carriers still do not really know where they stand. The German law on minimum wages affecting a substantial part of their as yet suspended only for transit. The German authorities intend to enforce it while in relation to cabotage and international transport to and from Germany. The question arises, he is in the light of the German Law Polish drivers and salary would have to be raised if, to meet the requirements. Professor Wladyslaw Gorski died

mountainIn recent days, I received very sad news, that 10 February 2015 r. Professor Wladyslaw Gorski died – an extremely important figure in the science of transport law. He was the ultimate authority in your field, author of more than 400 scientific publications, repeatedly highly decorated and obdarzanym various titles. He co-founded m.in. Civil Code and the Law – transport law. Polish science has lost a very important representative.

Unfortunately, it was not given to me personally know the Lord Professor, but from the stories of other people I know, he was not only a great scientist, but also very warm and affectionate man, who approached life with humor.

Lived 98 years old and left behind an enormous scientific achievements and – which for a scientist is not less important – worthy successors raised now forming “Szczecin school transport law”.

Some more details of life can be found in Professor Wikipedia or on University of Szczecin universities, with which he was associated for several years.

The funeral will be held on Friday 20 February 2015 r. at. 12.00 at the Central Cemetery.

There is a possibility of entry into the electronic Book of Condolences dedicated to Professor.

The entry for the New Year

Happy New Year to all readers, even if some of the previous year were not high – euphemistically speaking – activity 🙂 It's impossible to hide, that 2014 year both in terms of personal and professional life was for me quite exhaustive, which was reflected in a significant drop unfortunately substantive new blog posts. Among many of my New Year's resolutions, and it is, that this year the situation is not repeated. I hope, that at least I can keep this resolution tego

Transportation Manager Meeting Warsaw 25.06.2014 r.

One conference for us, second ahead 🙂 This time the meeting of more practical than scientific nature made a greater contribution to the transport industry, and less to lawyers and experts in transport law.

My presentation will cover the practical aspects of the recent judgment of the Court of Justice of the EU to allow carriers to initiate actions to establish the absence or limitation of liability for damage from the most advantageous for them to court, what I wrote once before on the blog.
